Rental Agreement

Rental Period and Payment

The periods of equipment and item(s) rented will be specified on the purchase order. Payment in full is due upon delivery. Customer agrees to pay all rental charges, delivery fees and other costs as itemized on the purchase order.

Use of Rental Item(s) and Inspection

The Customer acknowledges that rental equipment and item(s) are to be accepted on an “as is” basis. The Customer agrees to have visually examined all equipment and item(s) and is aware of its condition, finding it to be in good working order and repair. The Customer acknowledges his / her responsibility to return the rented equipment and item(s) to Julie’s Grills to Go in the same good condition, except for ordinary wear and tear. The Customer agrees not to use or allow anyone to use the rental equipment and item(s) for any illegal purpose or in an unsafe or negligent manner. No persons under 21 years of age may operate the equipment. Furthermore, the Customer agrees not to operate any equipment while intoxicated or under the influence of any illegal substances.

Delivery and Placement of Equipment/Item(s)

The Customer agrees that the equipment and item(s) will be used only at the address designated on the purchase order and only for the purpose for which the item(s) was manufactured and intended. Unauthorized moving of the items, subleasing or improper use is prohibited. Julie’s Grills to Go will at its discretion attempt to place equipment in location meeting the Customer’s specifications but does not promise that we can accommodate strategic placement of our equipment. Placement will be determined by where our vehicle can safely fit equipment without doing damage to your property or to ours.

Responsibility for Use and Disclaimer of Warranties

The Customer acknowledges that upon accepting the equipment and rental item(s) that there is a risk of injury or damage arising out of the use or operation of the equipment and item(s) and assumes all risks inherent in the operation and use of equipment and item(s).

The Customer agrees to assume all responsibility for the defense of, and to pay, indemnify and hold Julie’s Grills To Go harmless from, and hereby release Julie’s Grills to Go from any and all claims for damages to property or bodily injury (including death) resulting from the use, operation or possession of rented equipment and item(s), whether or not it be claimed or found that such damage or injury resulted in whole or in part from Julie’s Grills To Go negligence, from any defective condition of rented equipment and item(s), or from any cause. Julie’s Grills to Go is not liable to any damage to food and other goods or loss of time or inconvenience and, and Customer waives all claims for injury or damage to Customer’s property. The Customer agrees that no warranties, expressed or implied, have been made in connection with the equipment rented.

From the time equipment and item(s) are delivered to the designated location until it is retrieved from that same location, the Customer is responsible for it. If any equipment or items are lost, stolen, damaged under any circumstance while rented (including acts of God), the Customer assumes responsibility for all charges, including labor costs, to replace, restore or repair the equipment and item(s). Customer agrees to pay an additional cleaning charge of $75.00 in the instance that the equipment/rental items is returned excessively soiled. Accrued rental charges cannot be applied against the purchase or cost of repair of damaged or lost equipment. If any loss tends to indicate a crime may have been committed, the Customer must file a report to the proper law enforcement authorities and furnish Julie’s Grills to Go with a copy. Use of lighter fluid or other chemical accelerant during the use of rentals is prohibited unless approved by Julie’s Grills to Go.

Equipment Failure

The Customer agrees to discontinue the attempt to use the equipment should it at any time become unsafe or in a state of disrepair and agrees to immediately notify Julie’s Grills to Go of the failure of equipment rented. In the instance of equipment failure, Julie’s Grills to Go will replace the equipment with like equipment if available, otherwise adjustments to the rental fee will be modified as appropriate to reimburse all or a portion of the rental fee based on stage of equipment use at the time of failure.

Cancellations

Cancellations must be made within 48 hours prior to rental date. If a cancellation takes place after 48 hours cancellation timeframe, Julie’s Grills to Go reserves the right to charge for one day rental as a cancellation fee.
